Medical Malpractice

Also known as medical negligence. Describes failure of a doctor to provide care within recognized standards controlling the way that type of treatment or procedure is supposed to be given, causing injury to the patient. It is not defined by a bad result or the availability of another way of providing the care, unless it can be proven the doctor was required, by the appropriate standards of performance covering that type of care, under the circumstances, to have used the alternative method or to have used some recognized method to avoid the bad outcome.
