Nestle Toll House Cookie Dough Products Injury Alert- June 2009

FDA, CDC and Nestle USA Baking Division warn consumers to immediately stop consuming Nestlé® TOLL HOUSE® refrigerated cookie dough products due to possible contamination with E. coli bacteria. Recalled products are under investigation in connection with E. Coli food poisoning injuries occurring over 28 states.

            On June 19, 2009, the U.S. Food and Drug Administration and the Centers for Disease Control and Prevention warned consumers to not to eat any varieties of prepackaged Nestlé Toll House refrigerated cookie dough due to a risk they are contaminated with E. coli O157:H7, a bacteria that can cause food borne illness and injury, including a very serious kidney failure condition called hemolytic uremic syndrome (HUS). Nestlé, the product’s manufacture, has joined in and issued a nationwide recall of all of its refrigerated Toll House product lines to prevent consumer injury. FDA also warned retailers, restaurateurs, and personnel at food-service operations to not sell or serve any Nestlé Toll House prepackaged, refrigerated cookie dough products subject to the recall.             According to the warning published on the FDA’s website, the action was taken based upon results of an epidemiological investigation into an E. Coli outbreak that has been going on since March of this year that presently spans 28 states. Since March 2009, there have been 66 reports of illness. Twenty-five (25) persons were hospitalized; Seven (7) with Hemolytic Uremic Syndrome. So far, no one is reported to have died.

            FDA advises consumers that any prepackaged, refrigerated Nestlé Toll House cookie dough products in their home should be thrown away and not cooked. Nestlé’s recall announcement asks that any recalled products be returned to the store for a refund. According to the FDA cooking the dough is not recommended because consumers might get the bacteria on their hands and on other cooking surfaces, thus risking injury.

            If you or someone in your household has developed any symptoms of E. coli food poisoning such as abdominal cramping, vomiting or a diarrheal illness, often with bloody stools, it should be reported to local health agency and your family doctor contacted. You should also not throw out or return any unused product for refund. The health agency or your doctor may want to test the unused product and you may need it to support an injury claim. Before giving the product to your doctor or a health agency, photographs of all sides should be taken and kept. Your health care provider can obtain a stool culture that can determine if you have an E. coli infection. You should let your health care provider know that you or your family member consumed the suspect product and when it was consumed in relation to your symptoms.
