How Mediation Works in Family Law and Divorce Cases
Mediation is an informal process involving a qualified, neutral third party who helps families and couples resolve their disputes in ways that are acceptable to all sides. Importantly, a mediator is not a decision-maker. They simply guide other parties toward solutions by helping them explore their options and manage negotiations civilly.
Mediation sessions usually occur at pre-arranged sites convenient to both parties. During mediation, the mediator usually meets privately with each party to get their individual takes on the issues at hand, then proceeds from there to facilitate conversations and negotiations. The mediator’s goal is to find a solution that is beneficial and agreeable to both parties. If the parties reach a compromise, they can enter it as a binding and enforceable agreement in court. If not, both parties are free to pursue litigation.
